The SSA reviews the SSDI and decides whether or not to approve, deny, remand, or request additional information. The MDH Unit receives a memo from the SSA indicating whether the data related agreement is approved, delayed, or remanded. The MDH unit can proceed with execution if the agreement is approved.

If an applicant is denied, the SSA sends a second warning. The applicant is allowed to request a hearing before the Administrative Law Judge (ALJ) within sixty-five working days. This hearing is the same as those on disability issues. The hearing can be conducted in person, by phone or videoconference. The hearing can be held in person, over the phone or via videoconference. Witnesses may be brought to testify on the issues and circumstances surrounding denial. An ALJ may arrange for expert witness testimony to support the case. The ALJ will inform the applicant in writing if the application is denied. The hearing may take several months to complete.

Cognito Forms submits data-related agreements to SDI Team

A Data-Related Agreement is a legal document that requires approval from the SDI Team prior to execution. These agreements must be submitted via Cognito Forms. They must also include relevant documentation and contracts. The SDI Team has 30 days to review a Data-Related Agreement, and they may ask for more information such as security controls and a SOC 2 Type II audit. They may also request additional information, such as questions related to data migration.

Once a Data-Related Agreement was submitted, the SDI Team would review the documentation and propose contracts. The Agreement is subject to the same privacy and security policies as other forms of documentation submitted through Cognito Forms.
